Request to Cancel HQ O 250.1, "Civilian Radioactive Waste Management Facilities - Exemption from Departmental Directives" The Office of Civilian Radioactive Waste Management (OCRWM) requested to revise a JM written July 22, 2010 to answer questions regarding who would be responsible for the remaining obligations for Radioactive Waste Management. It was determined that NE would assume these responsibilities.  As HQ O 250.1 requires exemption paragraphs that refer only to OCRWM, a departmental element that was eliminated as of September 30, 2010, this Order is no longer necessary. DOE has made considerable progress in implementing project management policies and directives that make this one obsolete.  This Guide is used solely by Environmental Management (EM) is significantly out of date and based on legacy Project Baseline Summary (PBS) processes and procedures.  EM no longer designates an entire PBS as a project as DOE G 413.3-8 would suggest. DOE has made considerable progress in implementing project management policies and directives that make this one obsolete.  DOE O 413.3B no longer provides governance for the Information Technology (IT) capital asset projects.  Therefore, this particular companion guide (DOE G 413.3-14) is obsolete and unsupported by it's parent directive (DOE O 413.3B). Notice of Intent to Revise DOE G 413.3-4, "Technology Readiness Assessment Guide", DOE G 413.3-11, "Project Management Lessons Learned Guide", DOE G 413.3-13, "Acquisition Strategy Guide", DOE G 413.3-15, "Project Execution Plans Guide", DOE G 413.3-16, "Project Transition/Closeout Guide" and DOE G 413.3-17, "Mission Need Statement Guide" This memorandum provides justification for a revision of the subject Guides.  DOE O 413.3B, Program and Project Management for the acquisition of Capital Assets, was revised November 29, 2010.  As a result, the companion 413.3 Series Guides must be revised to align with the requirements delineated in the Order.  These Guides will not impose new requirements or constitute Departmental policy.  There are no valid external, consensus or other "Standards" (e.g., ISO, VPP, etc.) available which can be used in place of these Guides.

Notice of Intent to Revise DOE G 421.1-2, "Implementation Guide for Use in Developing Documented Safety Analyses to Meet Subpart B of 10 CFR 830" This Guide needs to be revised to bring it into conformance with expectations for DOE nuclear safety guides as delineated in DOE Order 251.1C, Departmental Directives Program, and the DOE's 2010 Directives Reform initiative.  In addition, the Guide needs to be revised to remove redundant information that is more appropriately contained in other DOE nuclear safety guides and standards such as information on PDSA development that is contained in DOE Standard 1189-2008, Integration of Safety into the Design Process. Request to Cancel DOE O 482.1, "DOE Facilities Technology Partnering Programs" Since the introduction of this Order, the Energy Policy Act (EPAct) of 2005 has established requirements for improved technology transfer at DOE Laboratories and Facilities.  The Act also requires the Department to establish an Execution Plan with regular updates. DOE has made considerable progress under a Secretarial Policy Statement on Technology Transfer, and implementing mechanisms by incorporating Department of Energy Acquisition Regulation (DEAR) provisions into the Management and Operating Contracts (M&O) to assure technology partnering is adequately addressed at the Laboratories, making the requirements of the Order redundant. Notice of Intent to Revise DOE O 3750.1, "Work Force Discipline" Significant changes from the Order include the deletion of material included in other documents such as statutes and Federal regulations.  In addition, an updated Table of Penalties now include Smoking, Cyber Security, Standards of Conduct or other Ethical Violations, and the incorporation of the Travel and Purchase Card Guidance dated January 2003.  This Order will soon be followed by a Guide which will contain all the "common sense" steps in the disciplinary process and the incorporation of case law concepts that do not rise to agency requirements and are no longer deemed appropriate for orders. Notice of Intent to Revise DOE Order 142.3, Change 1, "Unclassified  Foreign Visits and Assignments Program" This memorandum provides justification for a revision to Department of Energy (DOE) Order (O) 142.3, Change 1, Unclassified Foreign Visits and Assignments Program. Major changes included in this revision: (1) Removal of unnecessary or burdensome requirements, and (4) emphasis on site identification and tailoring or requirements based on risk. DOE O 142.3, Change 1 defines a program for unclassified foreign national access to DOE sites, information, and technologies by establishing requirements for access approval, reviews to ensure unauthorized access is denied, and documentation of visits and assignments. DOE O 142.3, Change 1, as part of a comprehensive security reform initiative currently underway within the Department, underwent an expedited review and revision. That effort was undertaken by a working group consisting of Headquarters program,  staff and support offices, federal field sites, and national laboratories.  Based on the identification both of issues and concerns related to implementation of the current directive, and of national drivers for the directive, the working group identified, and then modified or eliminated unnecessary or overly burdensome requirements. Notice of Intent to Revise DOE Order 210.2, "DOE Corporate Operating Experience Program" The need for an effective and comprehensive Operating Experience Program (OPEX) was a key lesson from both the Columbia Space Shuttle Accident and the Davis-Besse Reactor Pressure-Vessel Head Corrosion Event. As a result of these events, the Department established a new OPEX directive, DOE O 210.2, DOE Corporate Operating Experience Program, on June 12, 2006. The Order provides a system for identifying, collecting, screening, evaluating, disseminating and reviewing operating experience from within and outside of DOE that will help prevent adverse incidents and share good work practices. This revision will be conducted in accordance with the four year cycle established by DOE O 251.1C. A management team from the Office of Analysis (HS-32) will make edits to the Order to reflect organizational changes, update Web links, clarify and streamline responsibilities and requirements, and eliminate many identified redundancies. Notice of Intent to Revise DOE Order 225.1A, "Accident Investigations, 11-26-97" This memorandum provides justification for a revision to DOE O 225.1A. Major changes in this Order revision include (1) giving line managers the responsibility to appoint Federally-led accident investigation boards and eliminating the differentiation between Type A and Type B accidents (2) modifying the categorization algorithm to promote more timely decision-making; (3) giving line managers the responsibility for implementing corrective action systems to address identified deficiencies; (4) and clarifying line manager responsibilities for conducting extent conditions reviews. Historically, HSS has been responsible for appointing and leading independent accident investigations under this Order. As the numbers of the most severe accidents (Type A) have decreased and the investigation capabilities of the Program and Field Elements have increased, the need for HSS to independently lead investigations has diminished. The responsibility will be transferred to the responsible Heads of Programs Elements; the current Order provision that provides HSS with the authority to appoint an accident investigation board "as deemed-appropriate" is not anticipated to change. Portions of the Guide relating to the reporting and analysis processes will be incorporated into a new technical standard. Request to Extend the Notice for One Year, Department of Energy N 234.1, "Reporting of Radioactive Sealed Sources" DOE N 234.1 was submitted, reviewed, and approved according to DOE O 251.1B, and follows the directives program process in DOE O 251.1C, Appendix B, (Process #2), January 15, 2009. DOE N 234.1 has been implemented and serves as the basis for current DOE sealed source reporting. On June 9, 2009, DOE N 234.1 was extended until February 27, 2010, to provide time to complete coordination and deployment activities associated with the NSTS. Notice of Intent to Cancel Department of Energy Guide 440.1-3, "Occupational Exposure Assessment" DOE G 440.1-3 was written to provide guidance in meeting the exposure assessment requirements established in DOE O 440.1A. The Guide provide best practices for the operation of industrial hygiene exposure assessment and control programs at that time. These programs are used to manage health risks created by workplace exposures to hazardous chemicals and physical agents other than ionizing radiation (i.e., noise, laser light, etc.). This dated information has been superseded by guidance now contained in DOE-STD-6005-2001, Industrial Hygiene Practices, which references the third edition of A Strategy for Assessing and Managing Occupational Exposures, edited by J. S. Ignacio and W. H. Bullock, published by the American Industrial Hygiene Association (AIHA), and contains the most recent accepted approach to exposure assessment. As stated in the Department's directive system (DOE O 251.1C), guides provide and acceptable, but not mandatory, means for complying with requirements in orders and rules. This guide contains not requirements but does not provide useful information and best practices for tailoring and implementing a contingency protective force to support the conduct of sustained DOE operations during emergency situations. Request to Cancel DOE O 1340.1B, "Management of Public Communications Publication and Scientific, Technical and Engineering Publications" The Office of Public Affairs conducted a thorough review process to evaluate whether DOE O 1340.1B should be renewed, updated or canceled. As part of this review process, the Director of Public Affairs convened a meeting with press and management staff to discuss the Order. At this meeting, press staff explained that DOE public communications are now primarily reviewed at the program office level and that when policy issues and questions arise, program office's public affairs teams will consult PA as needed. PA requests that DOE O 1340.1B be canceled for the following reasons: (1). This directive was issued over 17 years ago, in January 1993. At that time, the Office of Public Affairs included two components - a press office and a public information office. The public information office was solely responsible for reviewing DOE public communications publications. This office was removed about five years ago. (2). Public Affairs and communications officers within the program offices have been reviewing publications produced by their offices and consulting with PA as needed. The best practices memorandum will clarify these responsibilities. Memo

Notice of Intent to Cancel DOE O 1450.4, "Consensual Listening-in to or Recording Telephone/Radio Conversations" After significant consultation with the Privacy office, General Counsel, and others, the OCIO concluded it does not have the legal standing to authorize the use of non-consensual listening tools. Should a DOE element need to use this tool in the future, the element would be responsible to coordinate such action with GC and other interested parties prior to requesting the OCIO provide technical support. The OCIO expects the only impact with the cancellation of this Order is a need to update DOE M 470.4-2A, Physical Protection which references this order. Revision of DOE Order 5480.19, "Conduct of Operations Requirements for DOE Facilities" The Order has been revised, renamed, and renumbered.  It is now DOE Order 422.X, Conduct of Operations, and is ready for DOE-wide review in RevCom. The proposed revision to the Order clarifies and refines DOE and contractor requirements and provides a contemporary CRD. The proposed revision to the Order was developed in accordance with the DOE Project Plan for Review of the HSS Safety Directives, approved in January 2008, and supports the principles governing Department Directives, as defined by the Secretary's memo of September 10, 2007, and subsequently incorporated into DOE O 251.1C, approved in January 2009. Notice of Intent to Revise Secretary of Energy Notice 35-91, "Nuclear Safety Policy" SEN-35-91 was identified as one of four SENs recommended for cancellation in a memorandum from Camille Beben, Directives Review Board Liaison, Office of Information Resources, dated July 2, 2009. It was recommended for cancellation because it was more than four years old and had never been reviewed and certified to verify its continued relevance. Following receipt of this memorandum, the Office of Health, Safety and Security (HSS), in coordination with the Chief of Nuclear Safety (CNS) and the Chief of Defense Nuclear Safety (CDNS), reviewed SEN-35-91 and concluded, as discussed below, that it continues to have relevance and that the policy needed to be updated rather than cancelled.  SEN-35-91 states the Department of Energy's (DOE's) basic nuclear safety policy from which specific nuclear safety rules, order, standards, and other requirements follow. Although the title indicates the document is a policy, it uses "must" and "shall" statements to establish important high-level nuclear safety requirements for nuclear safety programs that DOE and its contractors are to establish (e.g., technical competence and safety oversight). As specified in SEN-35-91, these high-level requirements have been implemented in DOE Directives and Standards, and can be converted to appropriate policy statements in the revision. Memo
