Not exactly. There's a legal doctrine known as estoppel that would prevent
DJB from suing for copyright infringement if, for example, he stated to you
"You can distribute modified qmail source despite what that page says" and you
had a provable record of that statement.
The note on his presentation slides *might* give you some legal shelter
against a claim, but it's not as ironclad as that -- I certainly am not about
to start treating qmail-1.03 as public domain and hoping his presentation
slides count as sufficient evidence for me to invoke estoppel. I'll be
comfortable once http://cr.yp.to/qmail/dist.html is changed.
